Terms of Service:
The company shall be known throughout this document as MegaHostNg.com.
The use of services from MegaHostNg.com, [Owned by TURNINGPOINT
INNOVATIONS] constitutes agreement to these terms:
1.) Account Setup
We will setup your account after we have received payment and we
and/or our payment partner(s) have screened the order(s) in case of
fraud. It is your responsibility to provide us with an email address
which is not at the domain(s) you are signing up under. If there is
ever an abuse issue or we need to contact you, the primary email
address on file will be used for this purpose. It is your
responsibility to ensure the email address on file is current or up to
date at all times. If you have a domain name registered with
MegaHostNg.com, it is your responsibility to ensure that the contact
information for your domain account and your actual domain name(s) is
correct and up-to-date.
MegaHostNg.com is not responsible for a lapsed registration due to
outdated contact information being associated with the domain. If you
need to verify or change this information, you should contact our
sales team via email. Providing false contact information of any kind
may result in the termination or suspension of your account.
In dedicated server purchases or high risk transactions, it will be
necessary to provide government issued identification and possibly a
scan of the teller used for the purchase. If you fail to meet these
requirements, the order may be considered fraudulent in nature and be
denied and no payment will be refunded.
2.) Content
All services provided by MegaHostNg.Com will not be used for unlawful
purposes. These includes, but not limited to: copyrighted material,
material we judge to be threatening or obscene, pornography etc.
Examples of unacceptable material:
IRC Bots
Warez Sites
Pirated Software
Hate Sites
Hack programs and archives
3.) Zero Tolerance Spam Policy
All services provided by MegaHostNg.Com may be used for lawful
purposes only we take a zero tolerance stance against sending of
unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double
optin" will be treated as spam. Any user who sends out spam will have
their account terminated without notice.
We reserve the right to require changes or disable as necessary any
web site, account, database, or other component that does/we feel do
not comply with this policy, at our sole discretion. We also reserve
the right to make any such modifications in an emergency at our sole
discretion without notice.
We reserve the right to charge the holder of the account used to send
any unsolicited e-mail a clean up fee. This cost of the clean up fee
is left entirely to the discretion of MegaHostNg.Com.
NOTE: If we suspect any fraudulent activity, copyright infringement,
or other illegal activity is occurring on any account maintained by
MegaHostNg.Com, we reserve the right to report the account to the EFCC,
Computer Crime Division WITHOUT WARNING or investigation.
4.) Payment Information
You agree to supply appropriate payment for the services received from
us, in advance of the time period during which such services are
provided i.e. one year in advance. You agree that we can disconnect
your site if you fail to pay/balance payment after 10 days of grace
period. Also note that we reserve the right to suspend your account
after this 10 days grace period and charge a reconnection fee of 15%
of the fee owed to us.
You agree to make payment for webhosting and domain name renewal
atleast 7days before the expring date. This will allow us plan for
renewal. Failure to do this may result in your domain name going down.
We reserve the right to change the yearly payment amount and any other
charges at anytime.
It is the customer's responsibility to notify our sales team via email
at, Admin @ MegaHostNg.Com after paying for a webhosting and/or domain
renewal and to ensure the email is received and acted upon. Domain
renewal notices and invoices are provided as a courtesy reminder and
MegaHostNg.Com cannot be held responsible for failure to renew a
domain or failure to notify a customer about a domain's renewal.
5.) Domain Name Registration Terms
The cost of registering a single domain name is =N=2,500 per annum.
You are to pay renewal fee of your domain days before its expiring
date. Failure to do this may result in another person taking your name
and we will not be responsible for this.
6.) Backups and Data Loss
Your use of the service is at your sole risk. We are not responsible
for files and data residing on your account. You agree to take full
responsibility for files and data transferred and to maintain all
appropriate backup of files and data stored on our servers.
7.) Cancellation and Refunds
We reserve the right to cancel the account at any time.
Customers may cancel at any time. Your webhosting services will
continue until you request for cancellation.
Note that billing and payment will continue until you contact us to
cancel as provided for in the above paragraph and after 2month failure
to make payment, we reserve the right to suspend your domain name
until payments are made.
We may give you an unconditional 30 day money back guarantee on
managed servers ONLY.
Only first-time accounts are eligible for a refund. For example, if
you've had an account with us before, cancelled and signed up again,
you will not be eligible for a refund or if you have opened a second
account with us.
As the case maybe, we may also refund money paid to us by a client for
services like websites design and website promotion. This refund is
ONLY possible if we failed to render the service requested by the
client and NOT WHEN WE ARE STILL IN THE PROCESS. Every refund for
services like website design etc will take 30 days from the day the
customers requested for refund via email.
Violations of the Terms of Service will waive the refund policy.
8.) Resource Usage
Users may not initiate the following:
a) Use 25% or more of system resources for longer then 90 seconds.
There are numerous activities that could cause such problems; these
include: CGI scripts, FTP, PHP, HTTP, etc.
b) Run any type of interactive real-time chat applications that
require server resources. Remotely-hosted services are fully allowed.
c) Run stand-alone, unattended server-side processes at any point in
time on the server. This includes any and all daemons, such as IRCD.
d) Run any software that interfaces with an IRC (Internet Relay Chat)
network.
e) Run any gaming servers such as counter-strike, half-life,
battlefield1492, etc
9.) Bandwidth Usage
You are allocated a monthly bandwidth allowance. This allowance varies
depending on the hosting package you purchase. Should your account
pass the allocated amount, we reserve the right to suspend the account
until the start of the next allocation, suspend the account until more
bandwidth is purchased at an additional fee, suspend the account until
you upgrade to a higher level of package, terminate the account and/or
charge you an additional fee for the over usages. Unused transfer in
one month cannot be carried over to the next month.
10.) Money Back Guarantee
This only applies to dedicated servers (webhosting account), no
refunds for domains once registered. We reserve the right to refund a
prorated amount or no refund at all.
11.) Price Change
The amount you pay for hosting will never increase from the date of
purchase. We reserve the right to change prices listed on our site,
and the right to increase the amount of resources given to plans at
any time.
12.) Indemnification
Customer agrees that it shall defend, indemnify, save and hold
MegaHostNg.com harmless from any and all demands, liabilities, losses,
costs and claims, including reasonable attorney's fees asserted
against MegaHostNg.com, its agents, its customers, officers and
employees, that may arise or result from any service provided or
performed or agreed to be performed or any product sold by customer,
its agents, employees or assigns. Customer agrees to defend, indemnify
and hold harmless MegaHostNg.com against liabilities arising out of;
(1) any injury to person or property caused by any products sold or
otherwise distributed in connection with MegaHostNg.com; (2) any
material supplied by customer infringing or allegedly infringing on
the proprietary rights of a third party; (3) copyright infringement
and (4) any defective products sold to customers from MegaHostNg.com
server.
13.) Disclaimer
MegaHostNg.com shall not be responsible for any damages your business
may suffer. MegaHostNg.com makes no warranties of any kind, expressed
or implied for services we provide. MegaHostNg.com disclaims any
warranty or merchantability or fitness for a particular purpose. This
includes loss of data resulting from delays, no deliveries, wrong
delivery, and any and all service interruptions caused by
MegaHostNg.com and its employees.
14.) Disclosure to law enforcement
MegaHostNg.com may disclose any subscriber information to law
enforcement agencies without further consent or notification to the
subscriber upon lawful request from such agencies. We will cooperate
fully with law enforcement agencies.
15.) Changes to the Terms of Services
We reserve the right to revise this policies at any time without
notice.
